1. BEDYCASA PRODUCTS AND SERVICES
1.1 BedyCasa community platform facilitating the publication of accommodation offers and room rental, either in part or in their entirety and on an international level. BedyCasa thus connects ‘travellers’ (users renting via the BedyCasa site) and ‘hosts’ (users wanting to rent out their accommodation via an advert present on the site) determined that they be both moral and real people.
1.2 All reservations on BedyCasa are managed by the General terms and conditional present and by a host-traveller contract, which is implicit to all transactions effectuated on the site and in accordance with the present conditions and respect for the rights and needs of both parties.
1.3 The BED AND LEARN group is not to be held responsible for the rental contract between host and guest, that is between the ‘host’ member (the user renting out accommodation either in part or in its entirety) and the ‘traveller’ member (the user reserving by replying to an accommodation offer present on BedyCasa), The BED AND LEARN group cannot be held responsible for any breach in the contract between the host and the guest (‘traveller’) on either part.
1.4 The BED AND LEARN group does not offer accommodation under its own name and cannot control the legitimacy of the host nor the accuracy of the information in relation to the location and/or the member’s profile as well as the content published by users.
1.5 The host must respect the law and legislations of their country concerning accommodation rental conditions relevant to the advertisement posted on BedyCasa. The BED AND LEARN group cannot be held responsible for any disrespect of laws and legal texts of the host’s country.
1.6 This service is exclusively reserved for those legally able to comply with French law
– “member”: represents everyone who creates an account on the BedyCasa site
– “host”: defines a user member who published an accommodation offer on the BedyCasa site.
– “traveller”: also previously referred to in the General Conditions section about host-guest contracts, the traveller is defined as a user member who is looking for accommodation or has entered into a confirmed reservation via the BedyCasa site.
– “the host-guest contract” and the rental contract binds the host user and the traveller user as traveller-host, as well as any members travelling in the party.
– “content”: represents all text, images, graphics, music, audio, video, or other material.
– “Advert”: represent the publication of an accommodation offer on the BedyCasa site.
– “B&l group”: represents the diminutive for The BED AND LEARN group.
2. Application, acceptation et modifications of general conditions of use
2.1 The use of the BEDYCASA (of the BED AND LEARN group) Internet site’s services as a host, traveller or simply a member means that they accept the present terms and conditions and of sales.
2.2 Subscribing as a user on BedyCasa implies the user’s acceptance and respect for the present general terms and conditions of use, the user thus declares to have read and understood the terms and conditions and general use of sale.
2.3 Modifications to the present terms and conditions: The BED AND LEARN group reserves the right to modify the terms, conditions and warning clauses in the present General Conditions of use, under the reserve of French law. As such, The BED AND LEARN group highly recommends that you regular read the present clauses in order to be informed about any future modifications.
2.4 The B&L group reserves the right to remove all members who do not respect the site’s general conditions of use.
3. BECOME A MEMBER : Membership and Inscription
3.1 To use BedyCasa’s services, the user member must proceed to their subscription and take responsibility for the information given on your profile. Each internet user who creates an account on their user space is characterised by an identification account name, and a password. The password allows the internet user to identify and connect themselves to our services is personal and confidential. The user is the sole party responsible for the user of their password. The user takes responsibility in keeping their password secret and not divulging it in any way.
3.2. Inscription on the BedyCasa site is reserved solely for users who are physical and moral people who can be held accountable for their acts by law. As such, minors cannot subscribe on BedyCasa. It is imperative that the user account of a moral person can be legally related to a named, physical person.
3.3 Once subscribed, a user takes responsibility for the information they communicate on the site, all erroneous information in relation to their identity and/or which could cause confusion with another user member of the site implies non-respect of the general conditions of use and a immediate cancellation of the contract between host and traveller. Any similar non-respect of code of ethics on the Internet will also mean immediate removal from the site.
3.4 By inserting an image or photo onto their profile, user members therefore authorise the BED AND LEARN group to re-use their content and in particular their photos and images for all supporting advertisements relative to the promotion of BedyCasa. Inserting images means that the user accepts their diffusion
3.5 BED AND LEARN group reserves the right to refuse access to all or any part of the Bedycasa.com website to any internet user, unilaterally and without any prior notification, notably in the instance of any violation against the present legal conditions by the internet user.
4. Community obligation for all members using BedyCasa
4.1 The user must give precise and correction information concerning their account and update it regularly via their personal user space. The user takes responsibility for any information they communication on the site, and the BED AND LEARN group cannot be held responsible for any consequences of information given, be this erroneous or incomplete on the part of the user. The user must also complete declaration documents concerning the information given on their user account if demanded by the BED AND LEARN group.
4.2 All user account information is personal and confidential, the user must therefore take responsibility for keeping this confidential.
4.3 The user must respect the proper functioning and usage the site and its service In no instance should an action on their part hinder the effective functioning and security of the site. The BED AND LEARN group reserves the right to block access and definitively remove the account of any malicious user on BedyCasa.
4.4 Users are forbidden to communicate:
– any false or incorrect information.
– any information which could be deemed as offensive towards race, ethnicity or which has a poltical, philosophical or religious stance, affiliated to a union, concerning sexuality, or health against good moral standing and the law.
4.5 Contact details and moderations on BedyCasa: connection with others is free on BedyCasa how all personal contact details should not and cannot be transmitted without authorisation from the BED AND LEARN group before a confirmed reservation on the site. An intelligent moderating system as well as BedyCasa personnel regularly monitors profiles, descriptions and conversation exchanges between members and reserve the right to delete any personal contact information given before the reservation has been confirmed. Certain members on the BedyCasa site have also expressed that they do not wish for their contact details to be diffused before this point of confirmed reservation. We thank you in respecting this. When you subscribe to the BedyCasa site (and all extensions of the site), you accept that your communication could be looked at and controlled by site administrators.
5. BECOMING A HOST MEMBER: Offering accommodation on BedyCasa
5.1 The host member on BedyCasa make available to all travellers-hosts and together those part of the rental contract between host and traveller, a rental offer which exists and is consistent with the description on BedyCasa. The host member must respect the laws and texts put into place concerning the rental of their accommodation, in part or in entirety, or whether they the landlord, tenant authorised by their landlord to sublet all or a part of their accommodation, or an authorised agent of the landlord of said accommodation. The BED AND LEARN group cannot be held responsible for the host’s conformity to laws and legislations in place in the country concerned.
5.2 The host user member commits to verifying the content of their advertisement and regularly updating it in any instance of moving address or any change to their personal contact details.
5.3 The host member on BedyCasa is aware that a commission of 15% of the price listed on their advertisement is rendered to BedyCasa’s service fees. This commission will be further added during the payment process. The host member must therefore verify their tariffs around their fixed price on BedyCasa, taking into account the 15% commission. The host member will receive as such a net host gain of 85% of their fixed price on BedyCasa for reservations with this minimal commission and once accepted by BedyCasa personnel.
5.4 The host member takes responsibility for the general conditions of use of BedyCasa and BedyCasa vows to treat this member equal to all other members on BedyCasa exclusively by a site mediator, the host member understands that they accept and respect to pass through the BedyCasa system to be directly connected to another BedyCasa member. In any instances of negligence, BedyCasa reserves the right to immediately and definitively remove the offer with its content on the site and the account of the user concerned.
5.5 With the acceptance of each reservation on BedyCasa, the host member verify the request before acccepting it: checking their availability for that period of stay concerned, the price listed on the site and the host net gain that they will receive, the accuracy of the accommodation address reserved by the member who will be staying there and their personal contact details, together with the responsibilites and services mentioned on their advertisement or that which has been specified during conversation about said reservation.
5.6 After accepting a reservation, the host member cannot modify their price which they have listed for that reservation request, to which is stated in article 5.4 above about verifying their prices and the net the host can gain for that reservation upon accepting it. After accepting the reservation the host vows to take responsibility for their advertisement and its engagements as well as the conversation exchanges with the other traveller/host member if no information contrary to this engagement was mentioned before the acceptance of said reservation such as for example the arrival/depart check-in/check-out times, the services included within the price etc.
5.7 Photos of the accommodation proposed by the host on BedyCasa: by uploading images and photos onto their profile and/or advertisement(s), the host authorises the BED AND LEARN group to re-use their content and in particular their photos on all supporting publicities relevant to the promotion of BedyCasa. By inserting images, the host accepts thus accepts their diffusion.
5.8 The host is the only one responsible for the content, photos and information that are published on their advertisement. As such any image diffused on their profile and/or their advertisement(s) and which could be re-used by BedyCasa, BedyCasa cannot be held responsible for any third party’s usage. BedyCasa cannot be held responsible in any instance of third party interception concerning all content, photos and images uploaded by users.
5.9 The host must respect the articles and laws in place in their country concerning legal and fiscal legislations for accommodation rental in part or total. The host is the only person responsible for any incidences with the landlord concerning any non-authorised subletting.
5.10 All host member who adhere to receive payment through BedyCasa’s ‘trusted third party’ for their accommodation, which can be validated upon the traveller’s arrival with a ‘reservation code’ (4 digit code) pre-registered and sent to the traveller in a confirmation email after the host has accepted the reservation. The host always receives a reminder email asking them to confirm the traveller’s arrival the day after their arrival date envisaged for the concerned reservation. The host member has up to a month after the specified arrival date to demand to have their payment transferred having registered the bank details or their Paypal account. If the host does not fulfil this within the time limit, they are no longer within their rights to demand for their payment transfer (unless there are justified forces majeures).
5.11 The host member on BedyCasa cannot ask for payment for a deposit ahead of the reservation date agreed. All deposit requests must be effectuated only when and only if the traveller arrives at the reserved accommodation.
6. Travellers WITH BedyCasa : rights and obligations
6.1 Like all user members on BedyCasa, a host-traveller user on BedyCasa must insure the information given on their user account is truthful. If the user is acting under another name on the account, the gender and the first name of the host-traveller requesting the stay must be told to the host before they accept their reservation on the Internet site. The host-guest contract will void if the host was not made aware of the host/traveller’s identity and if this identity is found to be different to that of the user’s account having edited the reservation or if that identity is then erroneous on BedyCasa. The traveller/host user will not be eligible for a refund in any instance of void of the contract for the reasons mentioned above. The user member traveller/host must be able to present a copy of a form of their identity upon the host user’s demand at any time during the stay reserved via BedyCasa. All of BedyCasa’s user member must respect these codes of ethics put into place on the Internet.
6.2 Traveller/guest members on BedyCasa must respect the host-guest contract as well as all their host’s lifestyle choices and household rules mentioned on the description before the reservation.
6.3 At the end of the host-guest contract, and as such at the finalisation of the reservation, the traveller will pay a down payment for or all of the total for the rental determined by the payment type chosen by the host prior to the reservation request. The rental price consists of the accommodation total, and BedyCasa’s fixed service charge rate of 3.90 euros; on each reservation and insurance too if the traveller/guest has opted to take out insurance with their reservation request. The traveller/guest must also accept the reservation process and system on BedyCasa and the bank authorisation demand effectuated on their bank account or on their Paypal account.
6.4 The payment type cannot be chosen by the traveller, is it solely that of the host user.
6.5 BedyCasa cannot be held responsible for any delay in bank autorisation effectuated with their bank card or their Paypal account resulting from the banking institution, the bank card holder or the company Paypal when using a Paypal account and any other being independent from the BED AND LEARN group.
6.6 The Disposition between travellers in different countries: the traveller-guest member is the only person responsible for the requirement relative to their travel (e.g. passport, visa, vaccinations etc.), they must also consult themselves about the Embassy or their Consulate in the country concerned (a useful link can be found at: http://www.embassyworld.com/.)
6.7 A reservation attempted with an account with a minor will not be effectuated, but rather only via a major’s user account with somebody who can have legal responsibility over the minor concerned.
6.7.a Minors who wish to leave the territory alone must refer to this article https://www.service-public.fr/particuliers/vosdroits/F1359 and download the Cerfa form.
6.7.b Minors are not permitted to drink alcohol unless the country of destination’s legislation allows
6.7.c Minors under the age of 16 years old are not authorised to go out alone (unaccompanied) during the evening except during school trips or if the country of destination’s legislation allows it
6.7.d All minors between the ages of 16 and 18 years old may go out in the evening until 1:00am, but only during the weekend- and only if the country and destination’s legislation allows it
6.7.e Minors are not authorised to travel alone in the country of destination or around and out of it- except in exceptional circumstances where the parent assume fully responsibility for such action
6.8 Damages infringed at the accommodation
7. CORRESPONDENCE BETWEEN PARTIES
Except in exceptional circumstances as mentioned in the present general conditions of use, exchange correspondence between BED AND LEARN group users are conducted by electronic mail
In the application the articles 1316 and in following Civil Code and, where necessary, article L.110-3 of the Code of Commerce, parties declare that information delivered by electronic mail is done with faith between parties in the sense that nothing written to the contrary authenticated and signed can put into doubt the information sent can be produced.
8. CANCELLATION CONDITIONS ON BEDYCASA
8.1 Cancellations by the traveller via payment with BedyCasa BedyCasa (100% paid upon reservation confirmation).
a. Cancellations for more than 10 days before the expected arrival date:
a.1 The traveller/tenant will be refunded 70% of the total stay, retained from the outstanding 30% on the total amount for the accommodation with an added 3.90 euros for the fixed fees rate on each reservation. A part of the stay will be refunded to the host user member who had blocked off the room for the traveller/tenant member.
a.2 The host member is given 15% compensation from the total sum of the accommodation in any case of the traveller cancelling 10 days or more before the traveller’s expected arrival date.
b. Cancellations between 10 days and 2 days before the expected arrival date.
b.1 The traveller/tenant will be refunded 50% of the total stay, retained from the outstanding 50% on the total amount for the accommodation with an added 3.90 euros for the fixed fees rate on each reservation. A part of the stay will be refunded to the host user member who had blocked off the room for the traveller/tenant member.
b.2 The host member is given 30% compensation from the total sum of the accommodation in any case of the traveller cancelling between 10 days and 2 days before the traveller’s expected arrival date.
c. Cancellations less than 2 days before the expected arrival date and during the stay:
c.1 It will not be possible to refund the traveller/tenant member, we consider this type of cancellation as a last minute cancellation.
c.2 The host member will be given 70% compensation of the total sum of the accommodation in any case of the cancellation by the traveller effectuated less than 2 days before the expected arrival date.
d. The host has up to a month starting from the cancellation date of the reservation to demand their compensation . If Bedycasa is not made aware of the cancellation, the month notice is taken from the reservation date.
e. Cancellation and Europ Assistance Insurance: la souscription à l’assurance lors de la demande de réservation permet au voyageur de prétendre au remboursement de la différence si les raisons de son annulation sont garanties par le contrat d’assurance, le voyageur-hébergé-assuré devra fournir l’ensemble des documents et prendre contact avec l’assureur dans les délais mentionnés sur le contrat d’assurance. Les frais d’assurance ne sont quant à eux non remboursables.
8.2 Cancellations be the traveller for payment on arrival (down payment paid by the traveller upon reservation request):
a. Compensations settled through BedyCasa cannot be refunded by the BED AND LEARN group to the traveller when the cancellation is initiated by the traveller.
b. Cancellation and Europ Assistance Insurance: subscribing to insurance when making a reservation request allows the traveller to claim for a compensation refund which can be settle if the reasons for their cancellation are covered by the insurance contract terms and conditions, the traveller/tenant/insured member must produce the necessary documents and get in touch with the insurer within the time scale mentioned on the insurance contract. Insurance fees are non-refundable.
c. No compensation can be given to the host if they have chosen the payment on arrival option.
8.3 Cancellation by the host member on BedyCasa with payment through BedyCasa
a. For all hosts who have opted for payment through BedyCasa’s “trusted third party” for the stated reservation, the cancellation conditions are as follows:
a.1 The host member should contact the BedyCasa customer services by sending an email to email@example.com and should also contact the traveller concerned for the cancellation. The reason for the host’s cancellation must also be justified.
a.2 All cancellations by the host will be subject to a penalty of 15% on the accommodation price of the next reservation payment made to them following the cancellation. The host will therefore receive 70% of the total amount for their accommodation upon the next reservation booking following the cancellation compared to the usual 85% they would normally receive
a.3 If the host fails to justify a cancellation with a reason accepted by theBED AND LEARN group or if the BED AND LEARN group deems it that there been too many cancellations by the same host member, the BED AND LEARN group reserves the right to remove this host member without warning.
b. Remboursement au voyageur suite à une Annulation Hébergeur.
b.1 BedyCasa’s services after point of sale offer help in finding an alternative solution for the traveller if their reservation is cancelled by the host member who can no longer receive them for the dates in question. The traveller will be entirely refunded for the cancellation effectuated by the host and with the choice of travel credit on BedyCasa they can reserve another accommodation of their choice, or via bank transfer following the registering of their bank details.
9. SECURE ONLINE PAYMENT
Bedycasa vous propose le système de paiement sécurisé PAYBOX DIRCET PLUS.
The payment method offered through BedyCasa is SSL secure.
This is a standard payment protocol which is recognized throughout the world for the protection of data transmitted via the Internet. It is available on practically all browsers (Internet Explorer V3.02 and subsequent versions of Microsoft, Navigator V1.1 and subsequent versions of Netscape, Firefox…).
The card information that you give (e.g. card number, expiry date etc.) are encrypted before being sent to your e-transactions payment host server.
10.1 Traveller Insurance EUROP ASSITANCE.
The traveller is given the free choice as to whether they subscribe to contracted insurance with Europ Assistance which is run via ALBINET offices on the BedyCasa site, covering the possible risks when renting via BedyCasa between traveller and host as well as insuring the traveller, under the following conditions. Europ Assistance’s general terms and conditions are available on BedyCasa on the following pages, the documentation to complete for your insurance can also be found on the website.
All demands or insurance claims are effectuated directed through ALBINET offices.
10.2 PROPERTY INSURANCE: Host User Member
All host members must thoroughly insure their property and ensure they have suitable insurance cover for the accommodation being rented for the entire duration that this accommodation is available to rent via BedyCasa.
EUROP ASSISTANCE Traveller insurance offers travellers and from that which is written in article 8.1 of the present General conditions of use only cover damages caused to the accommodation by the traveller/tenant who has taken out insurance for the specified reservation.
11. PAYMENT CONDITIONS FOR TRAVELLERS AND PAYMENT TO HOSTS
11.1 Payment for a reservation for the traveller/tenant member: The traveller/tenant member must complete all their reservation via the reservation system offered by BedyCasa. This will be effectuated by the payment method chosen by the host, with the entire stay paid for through BedyCasa when choosing the payment through BedyCasa option or a simple down payment if choosing payment on arrival. Payment methods accepted on BedyCasa are: 1. Bank card (Debit, Visa, Masterard) 2. PayPal.
11.2 The debit of the amount to be paid on BedyCasa will be effectuated as soon as the host accepts the reservation following approval from the bank or from PayPal for an payment authorisation, once the reservation request has been submitted by the traveller/tenant.
11.3 For all Card payments, the BED AND LEARN group uses the secure payment system: PAYBOX DIRECT PLUS, which works as a SSL secure payment. This payment protocol is a standard procedure and one which is known across the world for the protection of data transmitted on the Internet. This is available on nearly all navigator systems (Internet Explorer V3.02 and others from Microsoft, Navigator V1.1 and others from Netscape, Firefox, Chrome, etc.). The card data which you insert (e.g. card number, expiry date, etc.) are encrypted before being sent to your e-payment transactions
11.4 Already mentioned in article 6.5 of the present General Conditions of use, the BED AND LEARN group cannot be held responsible for any delay in bank authorisation with bank card or on a traveller/tenant’s PayPal account, this delay is the result of the user’s bank or PayPal as this account run independent to the BED AND LEARN group.
11.5 BedyCasa works in a way in which the site allows you to consult the total amount for fees on different adverts and in different foreign currencies on the payment page. The user member should understand that the conversion undertaken for a quote of their choice is not for information purposes and that the final rate could be different to that displayed by the user member. As a traveller/tenant member, you will be informed of the payment amount on the payment page for the reservation concerned, and this is the rate chosen by the host. Exchange fees applied to a payment for each different quote for that of your country of residence are independent and the BED AND LEARN group cannot take charge of them We advise you to take up this problem with your bank.
12.bis REOCCURING AND LONG STAYS
12.bis.1 PAYMENT CONDITIONS
12.bis.1.1 Eligibility Conditions:
Payment for reoccurring reservations will be applied to stays of 75 consecutive nights and over, only in cases where such reservations have been paid for via BedyCasa. This is not applicable for payments on arrival, unless the traveller requests their host to change their status to ‘temporary payment’ on BedyCasa.
12.bis.1.2 Initial Payment:
Initial payment concerns payment for the first two periods*.
12.bis.1.3 Automatic Payment for the following periods:
Payment will be automatically debited at the start of each of the following periods* unless the traveller states otherwise. The traveller will be notified of their next debit by email.
*Period: the traveller’s reservation will consists of several small reservations corresponding to several periods. E.g. a reservation of 3 months from 10th May 2016 until 10th August 2016 would divide into 4 periods:
- 10th May 2016 – 1st June 2016
- 1st June 2016 – 1st July 2016
- 1st July 2016 – 1st August 2016
- 1st August 2016 – 10th August 2016
12.bis.1.4 Payment methods:
The traveller can pay for their long stay (multiple full months), or reoccurring reservation (for example several nights across several months) via card, or via bank transfer upon request by sending an email to: firstname.lastname@example.org.
12.bis.2 PAYMENT CONDITIONS
The host will be paid the day after the start of a new period, as long as the host has entered their reservation code.
12.bis.3 CANCELLATION, REFUND AND DEPOSIT CONDITIONS
You can cancel your stay via BedyCasa or change a pending stay with a host, however charges will be applied depending on the scenario. If these charges correspond to the deposit for the host, the traveller will not be warned.
12.bis.4 CANCELLATION FEES BEFORE LEAVING
12.bis.4.1 Cancellation by the traveller:
12.bis.4.1.1 More than 30 days before leaving date:
The traveller being hosted will be refunded 70% for the first 30 days of the reservation and 100% of the remaining period. Service charges and insurance will not be refunded.The host will be refunded up to 15% for the first 30 days of the reservation.
12.bis.4.1.2 Between 30 and 10 days before leaving date:
The traveller being hosted will be refunded to up 50% for the first 30 days of the reservation and 100% for the remaining period. Service charges and insurance will not be refunded. The host will be refunded up to 15% for the first 30 days of the reservation.
12.bis.4.1.3 Less than 2 days before leaving date:
The traveller being hosted will not be refunded the first 30 days of the reservation because this amount will act as the deposit for the host. Never the less, the traveller being hosted will be refunded up to 100% of the remaining period. The host will be refunded up to 70% for the first 30 days.
12.bis.4.1.4 CANCELLATION FEES DURING STAY
30 days of rent will be retained to act as the deposit for the host. They will be refunded the sum of the days remaining minus those already gone. Service charges and insurance will not be refunded.The host will receive the sum of the 30 nights prior to the traveller leaving.
12.bis.4.2 CANCELLATIONS DUE TO FORCE MAJEUR
For cancellations due to force majeur (illness, loss, natural disasters or all other legitimate reasons) and justification (professional or educational obligations not considered as force majeure), 85% of the cost of the accommodation will be refunded to the traveller. Service charges and insurance will not be refunded.The host will not receive compensation for any force majeur cases.
12.bis.4.3 HOST CANCELLATION
BedyCasa’s customer service commits to finding an alternative solution for the traveller if the host can no longer accommodate them during the dates planned, and cancels their reservation. The traveller will be integrally refunded (excluding insurance) with either travel credits if they wish to make a new reservation on BedyCasa, or in the form of their payment method for the reservation.
A 15% penalty on the next reservation will be inflicted to hosts who cancel any paid reservation.
12.bis.5 STAY EXTENSIONS:
If the traveller being hosted wishes to extend their stay with their host longer than initially planned and confirmed, they must inform BedyCasa via email at: email@example.com.
Minors must complete the parental authorisation form and return it to us at firstname.lastname@example.org before confirming any reservation. A copy of this parental authorisation will be sent to the host. Download the form via the following link.
12.bis.7 ACCOMMODATION DECLARATIONS
BedyCasa can produce accommodation declaration forms for travellers so that they can legally justify their accommodation.
Generally, this declaration will allow them to obtain a VISA for the chosen country. This declaration form can be completed for travellers on request, once the host and the traveller have agreed upon the accommodation conditions. In which case the accommodation can be pre-reserved on BedyCasa with the host’s agreement (blocking the calendar on their account) whilst the traveller obtains their papers.
In the case of VISA requests for students outside of the European Community, BedyCasa can produce an accommodation declaration form (see paragraph on ACCOMMODATION DECLARATIONS). You can select this option for accommodation and BedyCasa will complete the accommodation declaration form with agreement from the host in order to help you obtain a VISA.
In the case of any VISA being refused and the accommodation has been paid for in advance with proof, the cancellation before leaving conditions will be applied. Service charges and insurance will not be refunded.
BedyCasa offers the option of multi-risk insurance. This insurance is strongly recommended for long stays. BedyCasa is not responsible for any incidents of stolen or damaged items during stays.
12. USER FEEDBACK ANDCOMMENTS ON BEDYCASA
12.1 Feedback after the stay: we strongly recommend that all BedyCasa user members as a traveller/tenant evaluate the host member and the accommodation reserved through BedyCasa and respectively as a host to evaluate the traveller/tenant in reference to their reservation. Feedback in the community is a sign of trust and credibility of the accommodation and its host on the one hand, and the traveller/tenant on the other. The B&L group works to display a collection of comments on BedyCasa following a stay, but also reserves the right to remove any comment, be it positive or negative in any case of doubt on the part of its author.
12.2 Evaluating friends: on BedyCasa, a user member can ask for a recommendation at any time from their friends simply by sending an email request, this recommendation will then act as a reference for the concerned user. Comments about reservations on a stated accommodation, about other accommodation a user has, or otherwise can be found under different window headings on BedyCasa via the feedback section in order to organise information for the visitor.
12.3 World Family label and World Traveller label: The World Family Label is awarded to all host user members on BedyCasa after receiving three positive evaluation after reservation of their accommodation advertisement. The World Traveller label is awarded to all traveller/tenant users after receiving three positive evaluation on their member profile after confirmed stays. A user can have both label simultaneously under their profile.
12.4 Feedback to BedyCasa: we happily invite you to send us your feedback (comments and suggestions) about our services and functionality of BedyCasa to help us to continually improve our services and functionality. Send your comments to the following address: email@example.com or you can complete the contact formula section on the BedyCasa website contact page. Via these present General conditions of use you thus accept that all feedback received by BedyCasa can be reused and become BedyCasa’s property, you also consent to this of your own free will, international patent, property rights or intellectual rights, moral rights and authorial rights.
13. REFERRALS ON BEDYCASA
13.1 Each user member on BedyCasa has a referral space on their own user account which allows them to invite friends or other that they know who BedyCasa’s services as a host or traveller/tenant member.
For each friend subscribed to BedyCasa, thanks to the referral programme on BedyCasa, you have the opportunity to earn BedyCasa Travel Credits on the first transaction effectuated or accepted by the referred member. The BedyCasa Travel Credits act as virtual money which can be used at any time without any minimum spending on the site.
13.2 In order to receive your travel credits, the referral must be considered as admissible, BedyCasa reserve the right to investigate the origins of any referral and the relationship between referrer and referee members. As a referral or referee, you cannot under any circumstances to complete a transaction as a host or traveller/tenant simply in order to gain travel credits.
13.3 The travel credit rewards on BedyCasa via the referral programme are as follows:
The referrer user member will receive 5 travel credits for their first reservation as a traveller/tenant for each of their referees.
The referrer user will receive 10 travel credits for their first reservation accepted as a host member for each of their referees.
The referrer user member can hope to gain a maximum of €15 for each of their referees who subscribe via the referral programme.
The referrer user will receive 5 travel credits once their subscription is complete at any time and without any minimum spend condition on BedyCasa.
French law only applies to the Internet website and General Conditions. In case of lawsuit, all proceedings will go through the Avignon legal department.
15. BEDYCASA’S COMMITMENT
15.1 PERSONAL DATA
Personal data gathered by BedyCasa (namely from forms) allow us to know you better and as such means we can offer you a better service. BedyCasa can use data on the site to inform you of its products. BedyCasa can also contact you by means of questionnaires aimed at getting your views and opinions about its existing or future products. BedyCasa will not sell or rent out its address lists to third parties. BedyCasa may however share data with trustworthy partners with a view of providing enhanced services, but your personal data will not be used for any commercial gains and to works to maintain and protect the confidentiality of any information you may provide.
15.2 INFORMATION TECHNOLOGY LAWS AND FREEDOM

16.1 INTERNET SECURITY
Surfers using the Bedycasa.com website are hereby informed about risks relating to technical specifications of the Internet network: BED AND LEARN S.A.S, cannot guarantee that information shared via the services circulated by BED AND LEARN S.A.S. will not be intercepted by third parties, nor does it guarantee that the confidentiality of exchanges is protected.
16.2 INTERNET USERS’ RESPONSIBILITY.
It is understood that users of the Bedycasa.com website possess the means required to access the site and are competent to use it.
It is further understood that the user has verified that the IT software they use does not contain any viruses and is in good working condition.
Finally, the user recognises that he has read and understood the legal warning stated and aggress to abide by it.
In relation to its activities, the BED AND LEARN group needs to circulate certain information, such as photographs, maps (Google Maps), software, and services developed by third parties the Bedycasa.com.
The BED AND LEARN group is not in any way, shape or form involved in the design and development of these services and cannot guarantee their proper functioning, reliability, pertinence, precision or exhaustiveness of the information, data and services circulated via Bedycasa.com.
Consequently, it is the user’s responsibility to make himself familiar with the information published on the Bedycasa.com site and independently carry out any verifications.
The user member understand the BED AND LEARN group is not responsible for rentals on the site in its name and cannot be held responsible against the traveller/tenant member for the rental condition of the accommodation for which chosen and published by the host user member.
BedyCasa is not responsible for those traveller/tenant or host who subscribe to the shite. Users are conscientious that they use the BedyCasa site at their own risk.
Warnings concerning host user members’ advertisements published on the site: the content on each advertisement, photos, text etc. are the property of the concerned member, the host member. All reproduction of such is prohibited without authorisation. Moreover, the BED AND LEARN group cannot be held responsible for the content or the lack of pertinent information inserted in the documents diffused on the site where to it is their responsibility alone to manage their advertisements.
As such, the internet user is advised to be prudent when dealing with information given on the BedyCasa sit, and to understand that all proceedings are taken under their own responsibility
16.3 LINKS WITH OTHER SITES
The Bedycasa.com site may contain hypertext links to other websites managed by third parties. The BED AND LEARN group cannot exert any permanent control on these sites nor can it assume any responsibility as to their content. BED AND LEARN cannot be held responsible for the content of these sites, nor the fact that these sites appear on the Bedycasa.com site and as such BED AND LEARN is in no way to be made liable.

• The pertinence and comprehensiveness of the websites in its index

L’ The user recognises that Wold Family aims to foster a practice of trust and togetherness in conformity with public morality on the Internet. Consequently, the user commits not to use the Bedycasa.com site for any illicit purposes and, namely, not to circulate messages or information, irrespective of its form or nature which:
• Conflicts with public order or morality
• Does not respect people’s private life
• Is harmful, disparaging, racist, xenophobic, of a revisionist nature or capable of undermining the credibility or reputation of others
• Incites discrimination or hatred
• Threatens one or a group of persons
• Is of a pornographic or paedophile nature
• Incites crime, a breaching of law or to a terrorist act, or being an apology for war crimes or crimes against humanity
• Incites suicide
• Violates laws about confidentiality of correspondence, or, in a broader context, contrary to a regulation or law in force
L’ Furthermore the user commits themselves to:

Any reproduction in whole or in part of these trademarks or these logos made from elements on this site without the expressed authorisation of BedyCasa is prohibited, according to articles L.713-2 and the Intellectual Property Code.
18. BedyCasa Loyalty Programme
18.1.1 The Loyalty programme is open to users aged 18 and over subscribed to BedyCasa. The Loyalty Programme is not open to businesses, associations or any other form of group. The user must have a valid email address and agree to the general terms and conditions, certifying to the truth of their contact details used on BedyCasa.
18.1.2 All pseudonyms, or usage of a BedyCasa user account acting under another name, could be subject to having their accumulated and offered nights taken away.
18.1.3 All fraudulent usage of an account or that which goes against the present general terms and conditions of use could result in an irrevocable cancellation, which could be effectuated without prior warning, of a user’s nights accumulated and offered or any other loyalty benefits they have received.
18.1.4 The removal of a user’s account also means the removal of any future nights accumulated as well as any other loyalty benefits linked to the Loyalty Programme. Nights offered as Travel Credits (benefits for host’s loyalty) cannot be sold, given away or transferred to another user’s account.
18.1.5 Nights offered will expire in 6 month (180 days) after the creation of night offered on the user’s Loyalty Program.
18.1.6 Host benefits in the form of Travel Credits will become unusable 12 months after the removal of and/or inactivity of the user’s advertisements.
18.1.7 The BedyCasa Loyalty Programme does not have an end date and remains in existence until the day BedyCasa-BED AND LEARN decides to end it. BedyCasa reserves the right to terminate the programme at any time. In such an instance, an alert would be sent to users giving them a 30 day deadline to use their nights offered and Loyalty Programme benefits. Once this 30 day deadline, after the alert announcing the end of the BedyCasa Loyalty Programme has been reached, all nights pending, accumulated, offered and all other host Loyalty benefits will be lost.
18.1.8 The BedyCasa BED AND LEARN Group reserves the right to modify the present general terms and conditions.
18.2. Host Loyalty Programme.
18.2.1 When receiving reservations as a host for one of your accommodation advertisements registered on BedyCasa, you’ll get 5 Travel Credits for every 10 nights accumulated and confirmed at your accommodation.
184.108.40.206 All reservations must be effectuated via the platform; nights will be confirmed 24hrs after the end of each stay proving that the traveller’s arrival has been fully confirmed by the host. BedyCasa reserves the right to cancel or to not confirm one or more nights if one or more elements have, or could have, hindered the smooth running of the reservation.
220.127.116.11 Nights are accumulated only on reservations effectuated via the platform itself or with advertisements linked solely to one user account. No transferring of nights accumulated from one user account to another is authorised. Nights will be confirmed onto the Loyalty Programme 24hrs after the end of the traveller’s stay and only to reservations where the traveller’s arrival was confirmed on the site and where that reservation does not show any signs of peculiarity or contentiousness.
18.104.22.168 BedyCasa reserves the right to invalidate any nights confirmed and as such to withdraw any Travel Credit benefits granted if it is found that the traveller did not in fact remain for the entirety of their reserved stay, or if any peculiarities or contentiousness are uncovered in retrospect.
22.214.171.124 BedyCasa reserves the right to invalidate all or a part of a host’s benefits which they received as Travel Credits via the Loyalty Programme in any instances where an advertisement or user account is removed due to non-compliance with the present general terms and conditions of use, or due to erroneous contact details or any mal-use of the site which could be seen by BedyCasa as prejudice.
18.2.4 Night stays from reservations made outside the Loyalty Programme cannot be taken into account as well as those made before the creation of the Loyalty Programme. Only reservations made and confirmed after the Programme’s creation can be accepted.
18.2.5 From your user account space you can at any time consult the nights pending linked to your reservations for dates of stay which have not yet passed, or for nights which have not yet been confirmed, as well as nights which have been confirmed and also see what benefits you’ve already gained on the Loyalty Programme. 18.2.6 Travel Credits are considered to hold the value of the amount displayed at the time when they were used for a transaction.
18.3. Traveller Loyalty Programme
18.3.1 Nights are accumulated solely on reservations effectuated via the platform, and with advertisements linked solely to one user account. No transferring of nights accumulated from one user account to another is authorised. Nights will be confirmed onto the Loyalty Programme 24hrs after the end of the traveller’s stay and only on reservations where the traveller’s arrival was confirmed on the site and where that reservation does not show any signs of peculiarity or contentiousness. The other people travelling within the party for that reservation cannot accumulate nights, and the number of nights accumulated has no relation to the number of people travelling in the party either.
18.3.2 In instances of using a night offered for a reservation where the price is lower than the value of the free night, you are not able to render the difference in any form, be it in cash, credit or any other means.
18.3.3 In instances of using a night offered for a reservation where the price is higher than the value of the night offered, you are obliged to make up the difference to reach the total for that reservation.
18.3.4 Used night offered are not showed in the Loyalty Programme. As such if you make a reservation for seven nights and use one night offered, only six nights will be shown in your Loyalty Programme. This remains the case even if the value of your nights offered are less than the value of the nights in question.
18.3.5 Night stays from reservations made outside the Loyalty Programme cannot be taken into account as well as those made before the creation of the Loyalty Programme. Only reservations made and confirmed after the Programme’s creation can be accepted.
18.3.6 From your user account space you can at any time consult the nights pending linked to your reservations for dates of stay which have not yet passed or for nights that have not yet been confirmed, as well as nights which have been confirmed, and also see what benefits you’ve already gained on the Loyalty Programme. 18.3.7 Once 10 nights have been accumulated and confirmed on your Loyalty Programme, one free night offered will be accredited to your Loyalty Programme to be used (when you choose) on one of your next reservations solely for accommodation advertisements where the host has chosen the payment through BedyCasa option. For all other offers where the host has chosen the payment on arrival option (payment due upon the traveller’s arrival at the accommodation), night offered cannot be used and will not be given as an option at the reservation completion stage.
18.3.8 The value of the nights offered is calculated by adding the value of the ten night’s stay (excluding BedyCasa service fees, insurance and other addition services), taken in chronological order of the nights confirmed onto your Loyalty Programme, this sum is then divided by ten (10). The value of one night offered is therefore equal to the average of the ten confirmed nights (excluding insurance, BedyCasa services fees and other additional services). When a promotion code or any other discount is used and affects the nightly price for a booking, the price per night offered with the fidelity programme will be changed as well.
18.3.9 As such, to be able to use your night offered, the reservation must have a minimum of one non-offered night. You can only use one night offered for the same stay, this stay should includes six non-offered night.
18.3.10. The value of the night offered will be automatically applied to the most expensive night reserved for your stay.
18.3.11 In any instance of a traveller cancelling a reservation comprising of one night offered, their user account will not be reaccredited.
18.3.12 In any instance of a host cancelling a reservation comprising of one or several nights offered, the traveller’s user account will be automatically reaccredited.
18.3.12 In any instance of modification to the date of your reservation, you must contact the BedyCasa team at: email@example.com, and whilst waiting for your first stay to be cancelled by the administration, your night offered will be reaccredited into your BedyCasa account so that you are able to re-launch your search and make reservations, knowing that your can use the night offered.
18.3.14 General conditions state that you cannot use this offer for one or more night’s stay in conjunction with any other form of offer.
BedyCasa bills the traveller, fees for each and every, confirmed booking. Those fees are fluctuating according to the price of each accomodation, between 4.90€ and 19.90€.
